General Terms and Conditions of Sale (CGV)
My House Manager – Property Management and Concierge Services
1. Legal Information
These General Terms and Conditions of Sale (hereinafter the “Terms”) govern the provision of services by EURL My House Manager, a company registered in France under SIRET number 980 008 056 00023, with registered office at 3 Rue Victor Hugo, 84480 Bonnieux, France. APE code: 6831Z. VAT number: FR61 980 008 056. Represented by its President, Madame Nassim Najfar.
Hereinafter referred to as the “Service Provider”.
2. Purpose
These Terms define the conditions under which the Service Provider provides property management, concierge, housekeeping, laundry, and related services (hereinafter the “Services”) to property owners or their representatives (hereinafter the “Client”).
The Client remains solely responsible for:
- Maintaining adequate insurance for the property (covering damage, theft, liability, and seasonal rental risks).
- Paying all utilities, taxes, and local levies, including tourist tax.
3. Ordering and Acceptance
3.1 Orders for Services may be placed by email, SMS, telephone, online form, or any mutually agreed method.
3.2 The Service Provider reserves the right to accept or decline any order at its discretion.
3.3 Acceptance of an order implies full and unconditional acceptance of these Terms.
3.4 The Client must notify the Service Provider in writing of all confirmed reservations at least seven (7) days before guest arrival. Without such notice, the Service Provider may be unable to guarantee the organisation of Services.
4. Service Provision
4.1 Services are provided in accordance with the specifications, timing, and scope agreed in writing with the Client.
4.2 The Client agrees to provide all necessary information, property access, and cooperation.
4.3 For urgent situations affecting safety or security (e.g. water leaks, break-ins, major equipment failure), the Service Provider will intervene as promptly as possible.
4.4 The Service Provider may, with prior agreement, advance expenses (supplies, groceries, replacements). These are invoiced at cost with receipts and must be reimbursed by the Client upon invoice.
5. Rates and Payment
5.1 Prices are agreed in advance and may vary according to complexity or special requirements.
5.2 Invoices are issued as specified in the service contract and are payable upon receipt, by bank transfer or secure payment link.
5.3 Any expenses advanced by the Service Provider are invoiced separately and reimbursed by the Client.
5.4 In case of late payment, applicable statutory interest and recovery costs shall be charged in accordance with Article L441-10 of the French Commercial Code.
6. Modification and Cancellation
6.1 Any modification or cancellation must be requested in writing by email to hello@my-housemanager.com.
6.2 Where costs have already been incurred, these remain payable in full.
6.3 Cancellations made on short notice may reduce service availability or result in additional costs.
7. Duration and Termination
Unless otherwise specified in a written contract, Services are provided for an open-ended duration.
Either party may terminate the agreement with 30 days’ written notice.
8. Confidentiality
Both parties agree to keep all information exchanged in the course of service provision strictly confidential, including property details, guest information, and financial data.
This obligation continues for one (1) year after termination of the agreement.
9. Data Protection
Personal data collected in the course of service provision is processed in accordance with GDPR. The Service Provider’s privacy policy is available at [link].
10. Liability
10.1 The Service Provider undertakes to deliver Services with professionalism and diligence.
10.2 Liability is strictly limited to the amount paid by the Client for the Service concerned.
10.3 The Service Provider shall not be liable for:
- Damage or loss caused by guests, third parties, or contractors not under its control;
- Defects inherent to the property (e.g. structural, equipment failures);
- Any indirect or consequential damages;
- Delays or failures due to force majeure events.
11. Force Majeure
Neither party shall be liable for non-performance caused by events outside their reasonable control, including but not limited to natural disasters, strikes, pandemics, or government restrictions.
During such events, obligations are suspended until conditions permit resumption.
12. Governing Law and Jurisdiction
These Terms are governed by French law.
Any disputes shall be submitted to the exclusive jurisdiction of the Commercial Court of Avignon, even in cases involving multiple defendants or third-party claims.
13. Amendments
The Service Provider may update these Terms at any time. Updated versions are published on the website https://my-housemanager.com/conditions-generales-de-vente/.
Updates apply automatically to all Clients. Notification of updates will be provided by email. Archived versions are kept by the Service Provider and may be provided upon request.
